Vehicles of Interest - Yamaha Rhino
Yamaha has been the leader in side-by-side vehicles with the Yamaha Rhino. Yamaha classifies this vehicle as a side-by-side off-road vehicle, but it has also been referred to as a Recreational Utility Vehicle (RUV), a Utility Vehicle (UTV), an All Terrain Vehicle (ATV), and even as a golf cart. The vehicle comes in three engine sizes: the RhinoTM 660, RhinoTM 700 and RhinoTM 450 models.
Klein, DeNatale, Goldner began litigation against Yamaha in 2004. In 2006, instead of recalling the vehicle and placing the appropriate safety devices on the Rhino, Yamaha issued new warning stickers that were sent to all owners. These stickers were to be placed on the roll bar and indicated that occupants of the vehicle should keep their arms and legs inside the vehicle during a rollover. These warnings did nothing to protect occupants of a Rhino from becoming injured in rollover accidents. In 2007, Yamaha issued new warning stickers that warn against turning the vehicle over, even on flat terrain. Yamaha also informed all owners they could take their Rhino to a Yamaha dealership and have doors installed free of charge.
