What does the case evaluation process involve?

This process usually involves a telephone interview with one of our attorneys. We will then overnight an intake package for you to fill out and return to us in a prepaid envelope we provide. Once we receive the intake package, our investigator will come to wherever you are and meet with you, interview witnesses, photograph the accident scene and the accident vehicle. If the accident happened in an area you are no longer living in, we will pay for our investigator to fly with you to the location of the accident so that the proper investigation can be conducted. At the same time, one of our attorneys will set up a time to meet with you and your family to go over the accident and the process of the lawsuit. Our legal team will then prepare and file a complaint.

How much does the case evaluation and filing a lawsuit cost me?

It will cost you nothing. We investigate cases at no cost to you – even if we decide not to take the case. If we file a lawsuit on your behalf, we pay all the costs of filing fees, experts, discovery, etc. If we get a settlement, or win at trial, then we are entitled to get those costs repaid to our firm. If the case goes to trial and we lose, you will not owe any costs.

Your firm is in California, but I live in a different state (or different country), can you still help me?

Yes. As we said before, we currently represent clients in side-by-side accidents from Alaska to California, as well as Florida, Maine, and everywhere in between. We also represent clients from Canada and the UK in side-by-side accidents.

Are these class action lawsuits?

Some law firms have mischaracterized the side-by-side litigation as a class action – this is not the case. There are currently no class action lawsuits involving the side-by-side vehicle. However, some firms will treat your case as a class action lawsuit by trying to group your accident into certain categories and then present the manufacturer with a category of cases and request sums of money for each category of cases. We believe this approach does a disservice to the client and we do not work this way. Our attorneys represent you individually against the manufacturer in an attempt to achieve the best possible result for your individual situation.

My friend was driving the side-by-side that I was injured on, and I don't want to cause any problems for him. What happens if I file a lawsuit?

Our legal team takes the position that the drivers of the side-by-sides involved in accidents, rollovers, or tip-overs have done nothing wrong. We have documented testing conducted by our experts that indicate the vehicles are unstable during typical turning maneuvers. For those reasons, we believe the driver's exposure is very limited – any attorney who tells you the driver will not be brought into the lawsuit is misleading you. We have been involved in dozens of side-by-side lawsuits where the manufacturer does file a cross-complaint against the driver.
